SWEEPSTAKES OVERVIEW:
Houston Area Chevy Dealers Twitter Hashtag Sweepstakes THIS SWEEPSTAKES IS INTENDED FOR PLAY IN THE STATE OF TEXAS ONLY AND WILL BE GOVERNED BY U.S. LAW. DO NOT ENTER IF YOU ARE NOT ELIGIBLE AND LOCATED IN TEXAS AT THE TIME OF ENTRY. HOW TO ENTER The Twitter Hashtag Sweepstakes (the “Sweepstakes”) will begin on April 9, 2012 at 9:00:00 a.m. Central Daylight Time (“CDT”) and end on April 27, 2012 at 8:59:59 a.m. CDT (the “Sweepstakes Period”). The Sweepstakes Period will be comprised of 5 prize periods (“Prize Periods”). The first Prize Period is between April 9 at 9:00:00 a.m. CDT and April 13 at 8:59:59 a.m. CDT. The second Prize Period is between April 13 at 9:00:00 a.m. CDT and April 17 at 8:59:59 a.m. CDT. The third Prize Period is between April 17 at 9:00:00 a.m. CDT and April 20 at 8:59:59 a.m. CDT. The fourth Prize Period is between April 20 at 9:00:00 a.m. CDT and April 24 at 8:59:59 a.m. CDT. The fifth and final Prize Period is between April 24 at 9:00:00 a.m. CDT and April 27 at 8:59:59 a.m. CDT. Sponsor will post a message at http://www.twitter.com/chevyhouston on Twitter when each Prize Period has ended. By participating, entrants agree to these Official Rules, which are final and binding in all respects. Sponsor’s clock is the official timekeeping device for this Sweepstakes. To enter the Sweepstakes, during the Sweepstakes Period follow Sponsor on Twitter at http://www.twitter.com/chevyhouston. You must have or create a non-private Twitter account in order to enter. If you are not an existing member of Twitter, you will be required to follow the directions and join Twitter. When you join Twitter, you are indicating that you have read and agree to accept the Twitter Terms of Service and Privacy Policy available at http://twitter.com/tos. Membership to Twitter.com is free. On April 7, 2012 at or around 9:00:00 a.m. CDT, Sponsor will post a question tweet beginning the first Prize Period (“Question Tweet”). To enter, post an answer to the Question Tweet containing “sponsor,” “@reply” to Sponsor (“Tweet”)., and hashtag “#chevyfuelsHOU.” You will receive one (1) Sweepstakes entry for your Tweet. Limit twenty-five (25) entries per person/Twitter account for each Prize Period regardless of the number of Tweets you post. All Entries must be tweeted before the conclusion of a Prize Period to be eligible. Entry must only contain an answer to the question asked in the Question Tweet, "sponsored,” “@reply," and hashtag “#chevydrivesHOU” to be valid. Each Prize Period will follow the procedure stated above and will begin immediately following the conclusion of the preceding Prize Period. Entries not in compliance with these official rules may be disqualified, in Sponsor’s sole discretion. Entries will be deemed to have been submitted by the authorized Twitter account holder associated with the username used to enter via Twitter. The authorized account holder is defined as the natural person who is assigned to a username by twitter.com. You must enter using only a twitter.com account subscribed to and registered in your name. The potential winner may be required to provide Sponsor with proof that he/she is the authorized account holder of the user name/Twitter Account associated with the winning entry. Entries that have been generated by a script, macro, bot or any other automated means will be deemed void. Participants may not register with multiple email addresses/Twitter accounts nor may entrants use any other device or artifice to register multiple times or as multiple registrants. Any entrant who attempts to enter with multiple twitter accounts under multiple identities will be disqualified and forfeits any and all prizes won, in Sponsor's discretion. Proof of submission of an entry shall not be deemed proof of receipt by the Sponsor. Twitter's computer is the official time keeping device for the Sweepstakes. ELIGIBILITY RESTRICTIONS One (1) prize will be awarded during each Prize Period. There will be a total of five (5) prize(s) awarded during the Sweepstakes Period: Each winner will receive one (1) one hundred dollar ($100) Visa gas card. Approximate Retail Value ("ARV"): $100 each. Gift cards subject to applicable terms and conditions. There is no substitution, transfer, or cash equivalent for prizes, except that the Sponsor may, at its sole discretion, substitute prizes of comparable value or cash. Unclaimed prizes will not be awarded. Limit one (1) prize per person/household. Total ARV of all prizes: $500.00. ARV is as of date of printing of these Official Rules. The difference in value of prize as stated herein and value at time of prize notification, if any, will not be awarded. If no documentation from winner is required, please allow 6-8 weeks after winner verification for shipment of prize. All taxes on prizes are the sole responsibility of winner. WINNER SELECTION AND NOTIFICATION One (1) potential winner will be selected at the conclusion of each Prize Period by the Sweepstakes Administrator in a random drawing of all valid entries received prior to the drawing for that specific Day of the Prize Period. Odds of winning in a particular Prize Period depend upon the number of eligible Entries received in that Prize Period. Potential winners will be notified via direct message to the winner's Twitter ID as recorded in the winner's Twitter account. Winners may be required to, in Sponsor's sole discretion, execute and return an Affidavit of Eligibility and/or Release of Liability Prize Acceptance Form within fourteen (14) days of attempted notification or prize will be forfeited. If a potential winner is a minor in his/her state of residence, prize may be awarded to the minor's parent/legal guardian who must sign and return all required documentation. If a potential winner cannot be contacted, fails to sign and return the required Affidavit of Eligibility and Release of Liability Prize Acceptance Form within the required time period, or if a prize or prize notification is returned as undeliverable, potential winner forfeits prize. Sponsor is not responsible for any change in Twitter account information, email, mailing address, and/or telephone number of entrants. CONDITIONS By participating in the Sweepstakes, the winner or winners agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this Sweepstakes without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize. Released Parties are not responsible for: (i) electronic transmissions or entries that are lost, late, stolen, incomplete, illegible, damaged, garbled, destroyed, misdirected or not received by the Sponsor or its agents for any reason, (ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures or human error that may occur in the transmission, receipt or processing of entries, or for destruction of or unauthorized access to, or alteration of, entries (iii) failed or unavailable hardware, network, software or telephone transmissions, damage to entrants’ or any person’s computer or cell phone and/or its contents, or causes beyond Released Parties’ reasonable control that jeopardize the administration, security, fairness, integrity or proper conduct of this Sweepstakes: (iv) any entries submitted in a manner that is not expressly allowed under these rules (all such entries disqualified); (v) incorrect or inaccurate entry information whether caused by entrants or by any of the equipment or programming associated with or utilized in the Sweepstakes, or (vi) any typographical or other errors in the printing, the offering or the administration of the Sweepstakes, or in the announcement of a prize. Sponsor’s decisions are final on all matters relating to this Sweepstakes. Sponsor reserves all rights, including the right to edit, publish, use, adapt, modify, or dispose of any Entry, for advertising and promotional purposes in all media (including, but not limited to, the internet) without limitation or additional compensation. If for any reason this Sweepstakes cannot be executed as planned, including but not limited to infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Released Parties that corrupt or affect the security, administration, fairness, integrity or proper conduct of this Sweepstakes, or if the Sweepstakes is compromised or becomes technically corrupted in any way, electronically or otherwise, the Released Parties reserve the right to cancel, terminate or modify the Sweepstakes. If Sweepstakes is terminated before the original end date, Sponsor will select the winners by random drawing from among all eligible non-suspect Entries received as of the termination time/date. Sponsor reserves the right, at its sole discretion, to disqualify and prosecute any individual who tampers with or attempts to tamper with the entry process or the operation of the participating stations’ websites or who enters using any automatic or programmed entry duplication method that is prohibited under these rules. CAUTION: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR OTHERWISE CORRUPT OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY, PROSECUTE AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Failure to comply with the Sweepstakes rules may result in an entrant’s disqualification solely at the discretion of the Sponsor. DISPUTES AND GOVERNING LAW As a condition of participating, participants (or their parent or legal guardian if an eligible minor) agree (and agree to confirm in writing): (a) to release Released Parties from any and all liability, loss or damage incurred with respect to the awarding, receipt, possession, and/or use or misuse of any prize, (b) that under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (c) all causes of action arising out of or connected with this Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action; and (d) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court. By entering, entrants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, participant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of State of Texas, without giving effect to any choice of law or conflict of law rules. By entering, entrants consent to the jurisdiction and venue of the federal, state and local courts for Dallas County, Texas.
